We’ve broken down their rules but please note all of this has been composed with the regulatory conditions of the United States of America (not any other country). 

None of this should be taken as legal advice or consulting so you might want to make use of the legal consultants out there to confirm if you’re selling CBD online outside the US.

note: Canadian merchants looking to sell CBD online must be registered under the Shopify plus plan AND be legally registered under law. 

Can I Sell CBD Products on Shopify?

Yes.

although there are some restrictions on merchants, Shopify does allow CBD products to be sold.

Example: Can I sell Delta 8 on Shopify?

A CBD product like delta 8 can be sold on Shopify.

In general, make sure your products on Shopify have levels of THC less than 0.3%.

What If I’m Not Selling CBD or Hemp Products in the United States(besides Canada)?

Selling CBD products in other geographies requires strict compliance with Shopify’s  policies – including their terms of service and acceptable use policy. 

The rough idea is that you’ll have to comply with all relevant local laws and regulations – though that’s not all you need to do.

For those Selling Hemp or CBD Products in the United States

  1. Submit the Attestation for the Sale of Hemp and Hemp-Derived Products

Here’s the (current) statements that must be confirmed before selling CBD on Shopify (in the US):

I confirm that my Shopify store operates from a state where the listing and sale of hemp and hemp-derived products is permitted by applicable state and local law. Note: The business address listed in the Admin for this store must be the same as the state from which you are conducting your business.

I confirm that all hemp and hemp-derived products listed or sold on my Shopify store contain not more than 0.3% tetrahydrocannabinol (THC) concentration on a dry weight basis or such lower percentage as required by applicable state and local law.

I confirm that no hemp or hemp-derived products listed or sold on my Shopify store are marketed as having any medicinal, disease-related or therapeutic benefit unless such claims have been approved by the Food and Drug Administration (FDA).

I confirm that all hemp and hemp-derived products listed or sold on my Shopify store have been sourced, processed, tested, labeled and marketed in compliance with all applicable federal, state and local laws.

I confirm that, if any hemp and/or hemp-derived products listed or sold on my Shopify store are intended for human or animal consumption via ingestion (including but not limited to food, food additive, beverage, dietary supplement, etc.):

by submitting this form, I confirm that I have the authority to bind the business operating this Shopify store and I confirm that all information provided in this form is true and will remain true for the duration that this Shopify store offers hemp and/or hemp-derived products for sale.

It is always advisable to check state and federal laws to make sure before selling hemp or CBD products on Shopify (Shopify also recommends keeping a tap on the FDA – food and drug administration)

Another (minor) note: SMS notifications are not allowed when selling hemp products. It is currently not supported.

Make sure when confirming the Attestation for the Sale of Hemp and Hemp-Derived Products you’re signed into the correct store (and the store’s address is located inside the united states).

Shopify POS: Can I Use it to Sell CBD or Hemp in my brick and mortar location(s)

Yes, but there are some things to keep in mind.

First, you cannot use the Shopify hardware that requires Shopify Payments to function.

Also to keep in mind is that an external CC (credit card) terminal is required (from the payment gateway you chose)

Do I Have Access to Shopify Experts if I’m Selling Hemp or Cannabidiol Products on Shopify?

Yes. As long as those Shopify Experts support your type of business you’ll have no issues – at least with Shopify – raised.

Fulfillment / Shipping for CBD or Hemp Merchants on Shopify

Determining where you can sell your products is one of first necessary steps – you’ll be able to configure your shipping zones in the Shopify admin dashboard to make sure orders for your CBD or Hemp products come from those locations.

Fulfillment of CBD products is made on a carrier by carrier basis – contacting them is the only way to confirm your product can be fulfilled that way.

Also make sure your CBD or Hemp goods are allowed to be shipped to your customer’s location.
